Occasionally we will see Nintendo take down certain romhacks or fangames if they get really big, but if they’re not remakes, not allowing players the ability to make their own remake of a Nintendo game, and don’t contain any copyrighted content or aren’t monetized in any way, they’re generally fine. These romhacks are generally released as patches, and as long as they aren’t directly distributing Nintendo-made assets, they tend to be okay. Super Mario 64 has hundreds of romhacks that add new music and levels to the game, and what we’ve witnessed in the last few years (as people kind of “came around” on Super Mario Sunshine and started claiming it as an underrated classic) is the dawn of a new romhacking scene for Super Mario Sunshine.
